1. Acceptance of Terms

By downloading or using the App, you agree to these Terms of Use. If you do not agree, do not use the App.

2. Subscriptions and Payment

The App offers the following auto-renewable subscriptions via Apple In-App Purchase:

• •Elevate Pro Monthly: 1 month, €7.99 per month
• •Elevate Pro Yearly: 12 months, €49.99 per year (equivalent to €4.99 per month)

• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
• Payment will be charged to your Apple ID account at confirmation of purchase.
• You may manage and cancel your subscription in your App Store account settings at any time.
• No refunds will be provided for unused portions of the subscription.

3. Use of the App

• The App is intended for personal and non-commercial use only.
• You agree not to copy, modify, distribute, sell, or lease any part of the App.
• We may suspend or terminate access if you misuse the App or violate these Terms.

4. Health Disclaimer

• The App provides fitness and wellness guidance but does not replace professional medical advice.
• Always consult a physician before starting any new exercise or nutrition program.
• Use of the App is at your own risk. We are not liable for injuries, health issues, or results arising from its use.

5. Data and Privacy

• We collect and process personal data as described in our Privacy Policy.
• Account registration is optional and only required if you want to sync progress across devices.

6. Intellectual Property

• All content, trademarks, and technology in the App are owned by us.
• You receive a limited, non-transferable, revocable license to use the App.

7. Limitation of Liability

• To the maximum extent permitted by law, we disclaim liability for indirect, incidental, or consequential damages.
• Our total liability to you for any claim shall not exceed the total amount paid by you in the past 12 months.

8. Changes to Terms

We may update these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms.

9. Governing Law

These Terms are governed by the laws of Austria, excluding conflict of law rules.
